<p>A solid team of technology support individuals is important to a companies success and reputation for several reasons. The technology support staff is often the consumers first and last impression of a company. That is a huge responsibility to the technology support team memebers. In dealing with technology support a consumer builds an immediate opinion about the products and brands sold by a company. Consumers also develop an idea of how imprtant they are as customers to a company. The most significant reason that a consumer calls the technology support department of a company in the first place is because they spent their hard earned money on a product that is no longer operating as it should. In general, this let down of sorts creates dissatisfaction in the consumer and so the technology support individual begins at a disadvantage.</p>
<p>The first thing one needs to do in beginning to build an effective technology support staff is to get stakeholder buy in. By that I mean high level management and or executives within the company. Based on my ownexperience, most companies, American based companies that is, do not view technology support as significant because there is no direct impact on sales. However, from my vantage point, I am firm in the idea that poor technology support over time will have an immense affect to sales and under mine brand marketing initiatives. With this in mind, we need to facilitate a bottom up understanding that there is in fact a correlation between technology support  and sales to get upper level buy in.</p>
<p>Documentation</p>
<p>Documentation of technology support issues, responses and fixes is key in developing a well funtioning technology support team. It is preferable to have a computerized trouble ticket system in place with a database backend to aid in resolving consumer issues. This way the resolutions for the most frequent consumer problems are easily accessible. In addition, an effective computer response system should provide a trouble tree like work flow. This allows the technology support team member to walk through a series of steps with the customer in deducing the cause and nature of the problem.</p>
<p>The absence of some form of computerized technology support system creates a scenario where technology support team members could potentially wind up solving the same or similar consumer complaints over and over again. This is not condusive to any company regardless of its size because any duplication of effort costs money. Another method of documentation is just as is indicated, physical documents or refence cards that are maintained by the technology support staff.</p>
<p>Communications</p>
<p>When searching for candidates to fill a role on a technology support team, one of the most important capabililites is to select a candidate who has excellent communication skills. As I stated earlier in this document, your technology support staff are often the only representation that customers have of a company. It is important that the hiring manager selects a candidate who listens and understands the customers complaint or issue. Also that technology support person needs to be knowledeable of his role and responsibilities in order to resolve the issue quickly.</p>
<p>The technology support employee must also be curteous, patient and professional at all times. Remember, more often than not, the technology support call coming from a customer is because your companys product has failed and let them down so they are frustrated and perhaps angry. The technology support team member must be able to work through this respectfully in order to diffuse the situation.</p>
<p>Personalites</p>
<p>Another element in building an effective technology support team is the consideration of the individual personalities of the team members. A team leader or management putting the team together needs to able to read people and decide what impact those team members may have on a team. Do the individual work well in a team environment? Do they handle peer critisism well? Are their work efforts and goals in line with the good of the team as a whole or are they self seeking? These are critical questions that a manager needs to consider if he or she is to build a team that will work well together for an extended period. If there is a significantly high rate of turnover on a team then training becomes an issue.</p>
<p>Conclusion</p>
<p>In my own experience in dealing with a technology support team as a consumer, it is important to me that the technology support person be sensitive to my particular problem. As recent as this passed week I had to call tech support for a network access issue with a company that I deal with regularly. I simply wanted to know why it was that I could send and receive emails from my personal email account using Microsoft Outlook without error at home, work and public access points; but I could not do so when connected to this one particular network. This was a network, which I spend a good deal of time on and it is a problem that I have to wait until I get home before I can send emails.</p>
<p>I suspected that it was a network security issue and that port 25, the outgoing mail server SMTP port; was closed to students. Instead of giving me an answer, the technology support staff member first tried to push the responsibility off onto my ISP. When I explained to her that I am the ISP and that I have a business which supplies web and email hosting services she seemed frustrated. After a brief discussion she indicated that I needed to contact Microsoft technology support and have them fix the issue. I explained to her that it is not a Microsoft issue because the software operates as expected on every network except theirs. Further I told her I had been setting up email clients since 1995 and this was not the problem.</p>
<p>Finally the technology support person placed me on hold for more that 20 minutes and I began to feel like I had been hung out to dry and so I eventually just hung up the phone because time was being wasted. This is a potentially volitile situation because had this been a consumer who was frustrated, they may have hung up the phone even more frustrated. These non-resolutions can severely impact brand popularity and sales over that duration of time.</p>

There are still agencies willing to lend funds to individuals who have bad credits and they classify these cases as &#8220;credit risks.&#8221;</p>

			<content:encoded><![CDATA[<p>Alimony is payments that one spouse may be ordered to pay another spouse for support as a result of a divorce. In Rhode Island Divorce, some spouses qualify for  alimony from the other spouse. Alimony is also known as Spousal Support or Spousal Maintenance.</p>
<p>R.I.G.L 15-5-16 delineates the factors that the Rhode Island Family Court Judge should use in determining whether a Husband or Wife Qualifies for Alimony payment from the other spouse.</p>
<p>The Rhode Island Supreme Court Stated &#8220;Alimony is a rehabilitative tool intended to provide temporary support until a spouse is self-sufficient, and is based purely on need.&#8221; Berard v. Berard  The Rhode Island Alimony statute is set forth below. You should contact David Slepkow to get legal advice concerning your case.</p>

<p>Generally, Alimony is awarded for a specific period of time, in increments which are usually weekly or monthly. Alimony could be awarded as a result of a Divorce settlement. If a party requests alimony or is unwilling to waive alimony and the parties cannot agree to an alimony award, then alimony may be awarded at the divorce trial.</p>
<p>Temporary Alimony may be awarded by the Rhode Island Family Court  towards the beginning of the RI divorce. This temporary Alimony award will stay in effect until the final decision by the Rhode Island Family Court Judge at the RI Divorce Trial.</p>
<p>The intent of alimony is rehabilitative in nature. &#8220;alimony should be &#8216;payable for a short, but specific and terminable period of time, which will cease when the recipient is, in the exerciseof reasonable efforts, in a position of self-support.&#8217;&#8221; Thompson v. Thompson</p>
<p>Alimony is usually awarded on a temporary basis but can be awarded on an indefinite and (perhaps what turns out to be permanent) basis if the facts justify indefinite alimony. The Rhode Island Supreme Court ruled that &#8220;Alimony may be awarded even for an indefinite period as long as the trial justice considers all the statutory factors.&#8221;</p>
<p>Indefinite alimony may be ordered in a case where a party is seriously disabled or as a result of old age is unable to work. Indefinite alimony could also be awarded in a plethora of different factual circumstances.</p>
<p>The Court must look at &#8220;The health, age, station, occupation, amount and source of income, vocational skills, and employability of the parties&#8221; in making an alimony determination.</p>
<p>Ability to pay is a crucial factor in determining the amount of alimony and whether or not alimony should be awarded. There are many cases in which a spouse is in desperate need of alimony but the other spouse does not have the ability to pay sufficient alimony. In some cases, the spouse does not have an ability to pay because of a child support obligation to the other spouse or child support owed for other children.</p>
<p>Furthermore, according to The Rhode Island Supreme Court, &#8220;Section 15-5-16 does not explicitly prohibit one lump-sum award.&#8221; However,  lump sum award alimony appears to be disfavored under RI Law.</p>
<p>The best candidate for alimony is a spouse who put aside his or her career ambitions for many years to be a homemaker and care for the children. As a result of the role of nurturing the children and establishing and maintaining a home, the other spouse was able to advance his or her career in order to be able to afford to pay alimony.</p>
<p>In some cases, the family made a decision that one parent would put aside his or her career aspirations to raise a child or minor children. As a result, the homemaker&#8217;s skill set is so outmoded that he or she is unable to obtain suitable employment. This is usually because the homemaker&#8217;s job skills, employment history, licenses, training, skills, experience or degrees became outmoded or irrelevant. Perhaps the person does not have enough of an employment history to be able to be self supporting and self sufficient without receiving alimony. In some cases the spouse is unable to work because the spouse currently has a physical custody and placement of a young child.</p>
<p>For this type of person, the intent of an award of Rehabilitative Alimony would be to allow a person to build a work history, advance his or her education, employment training, licenses etc. so that the person can be self supporting and self sufficient in the future.</p>
<p>Another type of person who is an excellent candidate for alimony is a person who is temporarily disabled or permanently disabled especially if the marriage has been a long marriage. Another good candidate for alimony is a spouse who has severely disabled children which renders it difficult  or impossible for the person to seek employment.</p>
<p>&#8220;The assignment of property must precede any determination of alimony because the needs ofeach party will be affected by the equitable distribution of the marital estate.Section 15-5-16.1(c). In determining the amount of alimony, the court must consider: &#8220;(i) [t]helength of the marriage; (ii) [t]he conduct of the parties during the marriage; (iii) [t]he health, age,station, occupation, amount and source of income, vocational skills, and employability of theparties; and (iv) [t]he state and the liabilities and needs of each of the parties.&#8221; Section15-5-16(b)(1).6</p>
<p>Rhode Island Child Custody and Placement plays a role in an alimony determination. If the parties have children, the Court must also make an award of Rhode Island Child Support before the Court determines an alimony award.  The Child Support award plays a large role in determining the resources of the parent with physical custody of the minor child. <p>The needs and expenses of both parties is crucial in determining alimony. Needs and expenses are intertwined with the standard of living of the parties. The Court may look at the following types of expenses and needs: rent, mortgage, taxes, insurance, food, health insurance, uninsured medical expenses, prescription expenses, dental expenses, cable, internet, utilities, heat, gas , vehicle expenses etc.</p>
<p>Although conduct is a factor in alimony determinations per the RI Alimony Statute, it is not a significant factor since alimony is basically need based. Conduct such as an affair, drug or alcohol addiction, gambling problem, domestic violence plays more of a role in equitable division of assets then in an Alimony determination.</p>
<p>An award of alimony has Federal Income Tax consequences. Alimony is taxable to the spouse who receives the alimony and is deductible by the spouse who pays alimony. In order to qualify as alimony,</p>
<p>Alimony must terminate on the death of the payee spouse and upon the remarriage of the payee spouse. Payment of alimony is a taxable event to the payee spouse.</p>
<p>This is very different from payment of child support. Payment of child support is a non taxable event. The parent who pays child support is not entitled to a deduction for payment and the receiving spouse does not include the payment as income. Therefore it is tax free money to the parent who receives the child support.26 U.S.C.A. 71.</p>
<p>The IRS has rules and regulations concerning what types of payments constitute alimony. The IRS has rules and regulations concerning when a parent tries to mask child support payments as alimony. Please consult with a Rhode Island Divorce and Family Law Attorney concerning the tax implications and rules concerning Alimony. A detailed explanation of tax rules, laws and regulations as they pertain to Alimony is beyond the scope of this article.</p>
<p>The designation of payments as alimony rather than property distribution has consequences in Bankruptcy Proceedings. An alimony award is generally not dischargeable in Bankruptcy. The interrelation between Family Law, Alimony and Bankruptcy is also beyond the scope of this article. Please consult with a Rhode Island Bankruptcy Lawyer/ Attorney.</p>
<p>Another important issue, perhaps crucial issue, is whether or not the parties enter into a property settlement agreement in the divorce.  In order for the alimony to be completely non modifiable, the alimony must be agreed to in a Property settlement agreement. The Court has no power to modify a property settlement agreement. A Court can only enforce or interpret a property settlement agreement. In the event of impossibility of payment, the Court could award equitable relief, equitably reforming the contract between the parties.  Please contact a Rhode Island Divorce Attorney concerning whether or not it is advisable to draft a Property Settlement agreement in your case.</p>
<p>Proper drafting of a Property Settlement Agreement and Alimony provisions in a Property Settlement Agreement is beyond the scope of this article.</p>
<p>The length of the marriage is a very important factor that the RI Family Court Judge looks at in determining Alimony. The Court also needs to hear testimony concerning the party requesting alimony plan to become self supporting and self sufficient.</p>
<p>The Court can also look at the relative ability of both spouses to earn income and or acquire assets and property in the future.</p>
<p>If a person is ordered to pay alimony and does not pay alimony, the other person can file a contempt motion. If a person is found in willful contempt of a Court order they could be jailed until they purge themselves of the contempt. Rhode Island Family Court judges take failure to comply with their alimony orders very seriously. If the Alimony award is modifiable, either party could file a motion to modify the alimony based on a substantial change in circumstances.</p>
<p>§ 15-5-16 Alimony and counsel fees &#8211; Custody of children.</p>
<p>(a) In granting any petition for divorce, divorce from bed and board, or relief without the commencement of divorce proceedings, the family court may order either of the parties to pay alimony or counsel fees, or both, to the other.</p>
<p>(b) In determining the amount of alimony or counsel fees, if any, to be paid, the court, after hearing the witnesses, if any, of each party, shall consider:</p>
<p>(i) The length of the marriage;</p>
<p>(ii) The conduct of the parties during the marriage;</p>
<p>(iii) The health, age, station, occupation, amount and source of income, vocational skills, and employability of the parties; and</p>
<p>(iv) The state and the liabilities and needs of each of the parties.</p>
<p>(2) In addition, the court shall consider:</p>
<p>(i) The extent to which either party is unable to support herself or himself adequately because that party is the primary physical custodian of a child whose age, condition, or circumstances make it appropriate that the parent not seek employment outside the home, or seek only part-time or flexible-hour employment outside the home;</p>
<p>(ii) The extent to which either party is unable to support herself or himself adequately with consideration given to:</p>
<p>(A) The extent to which a party was absent from employment while fulfilling homemaking responsibilities, and the extent to which any education, skills, or experience of that party have become outmoded and his or her earning capacity diminished;</p>
<p>(B) The time and expense required for the supported spouse to acquire the appropriate education or training to develop marketable skills and find appropriate employment;</p>
<p>(C) The probability, given a party&#8217;s age and skills, of completing education or training and becoming self-supporting;</p>
<p>(D) The standard of living during the marriage;</p>
<p>(E) The opportunity of either party for future acquisition of capital assets and income;</p>
<p>(F) The ability to pay of the supporting spouse, taking into account the supporting spouse&#8217;s earning capacity, earned and unearned income, assets, debts, and standard of living;</p>
<p>(G) Any other factor which the court expressly finds to be just and proper.</p>
<p>(c) For the purposes of this section, &#8220;alimony&#8221; is construed as payments for the support or maintenance of either the husband or the wife.</p>
<p>(2) Alimony is designed to provide support for a spouse for a reasonable length of time to enable the recipient to become financially independent and self-sufficient. However, the court may award alimony for an indefinite period of time when it is appropriate in the discretion of the court based upon the factors set forth in subdivision (b)(2)(ii)(B). After a decree for alimony has been entered, the court may from time to time upon the petition of either party review and alter its decree relative to the amount and payment of the alimony, and may make any decree relative to it which it might have made in the original suit. The decree may be made retroactive in the court&#8217;s discretion to the date that the court finds that a substantial change in circumstances has occurred; provided, the court shall set forth in its decision the specific findings of fact which show a substantial change in circumstances and upon which findings of facts the court has decided to make the decree retroactive. Nothing provided in this section shall affect the power of the court as subsequently provided by law to alter, amend, or annul any order of alimony previously entered. Upon the remarriage of the spouse who is receiving alimony, the obligation to pay alimony shall automatically terminate at once.&#8221;</p>

What traits or characteristics are inherent to a successful entrepreneur and is one born with those traits? There&#8217;s great news! Successful entrepreneurs are born every day!</p>
<p>Some people believe an entrepreneur is born while others believe an entrepreneur can be taught. Some believe an entrepreneur is like an artist &#8211; either you have it or do you don&#8217;t. Some see entrepreneurs as leaders that are focused, disciplined, competitive, and charismatic, while others see them as huge risk takers. And all of these analogies are right to some degree. </p>
<p>It&#8217;s true all successful entrepreneurs share a few qualities and skills that allow them to be successful. These inherent qualities can be taught; but they often seem to be an inherent driving force that sends individuals down the path of being in business or formally training to for a career in business.</p>
<p>Entrepreneurs see the world differently. They have the ability to see the world as a system. They have the ability to see something in its entirety and as an integrated unit, and they seem to possess the ability to see opportunity within the global picture. They are what is called a system thinker. </p>
<p>There are other characteristics they possess. Entrepreneurs possess an overpowering need to achieve and tend to be very competitive against themselves. They are continuously trying to outthink themselves and others and they are constantly looking for the edge. This is a process that occurs as naturally as breathing and is a driving force behind most entrepreneurs.</p>
<p>They have the determination and dedication to follow through with commitments and they always appear confident and in control. You&#8217;ll notice they also possess a positive atmosphere. They are of the mindset &#8220;I can,&#8221; and &#8220;I will.&#8221; They are not afraid of failure because failure is not in their vocabulary nor is it an option.</p>
<p>They are objective but have the ability to weigh risks realistically within the big picture. They have an uncanny ability to anticipate developments which gives them the edge on many competitive situations. Entrepreneurs seem to feel right from their gut, call it instinct. They are a resourceful group that possess excellent problem solving skills and are able to diligently work through obstacles as they occur. </p>
<p>Entrepreneurs are excellent communicators and recognize how important clear and concise communication is to their success. They also possess a sound working knowledge of the business they are involved in.</p>
<p>When it comes to successful entrepreneurs it&#8217;s a question of what came first, the chicken or the egg. Is it inherent qualities that we are born with that lead us to be entrepreneurs or is it when we choose to become an entrepreneur that we develop the skills and qualities of success? That&#8217;s a question we shall leave to the great debaters to resolve.</p>
<p>What is for certain is that successful entrepreneurs are born every day and that you too can be a successful entrepreneur by developing the skills of success.</p>

<p>A solid team of technology support individuals is important to a companies success and reputation for several reasons. The technology support staff is often the consumers first and last impression of a company. That is a huge responsibility to the technology support team memebers. In dealing with technology support a consumer builds an immediate opinion about the products and brands sold by a company. Consumers also develop an idea of how imprtant they are as customers to a company. The most significant reason that a consumer calls the technology support department of a company in the first place is because they spent their hard earned money on a product that is no longer operating as it should. In general, this let down of sorts creates dissatisfaction in the consumer and so the technology support individual begins at a disadvantage.</p>
<p>The first thing one needs to do in beginning to build an effective technology support staff is to get stakeholder buy in. By that I mean high level management and or executives within the company. Based on my ownexperience, most companies, American based companies that is, do not view technology support as significant because there is no direct impact on sales. However, from my vantage point, I am firm in the idea that poor technology support over time will have an immense affect to sales and under mine brand marketing initiatives. With this in mind, we need to facilitate a bottom up understanding that there is in fact a correlation between technology support  and sales to get upper level buy in.</p>

<p>Documentation of technology support issues, responses and fixes is key in developing a well funtioning technology support team. It is preferable to have a computerized trouble ticket system in place with a database backend to aid in resolving consumer issues. This way the resolutions for the most frequent consumer problems are easily accessible. In addition, an effective computer response system should provide a trouble tree like work flow. This allows the technology support team member to walk through a series of steps with the customer in deducing the cause and nature of the problem.</p>
<p>The absence of some form of computerized technology support system creates a scenario where technology support team members could potentially wind up solving the same or similar consumer complaints over and over again. This is not condusive to any company regardless of its size because any duplication of effort costs money. Another method of documentation is just as is indicated, physical documents or refence cards that are maintained by the technology support staff.</p>
<p>Communications</p>
<p>When searching for candidates to fill a role on a technology support team, one of the most important capabililites is to select a candidate who has excellent communication skills. As I stated earlier in this document, your technology support staff are often the only representation that customers have of a company. It is important that the hiring manager selects a candidate who listens and understands the customers complaint or issue. Also that technology support person needs to be knowledeable of his role and responsibilities in order to resolve the issue quickly.</p>
<p>The technology support employee must also be curteous, patient and professional at all times. Remember, more often than not, the technology support call coming from a customer is because your companys product has failed and let them down so they are frustrated and perhaps angry. The technology support team member must be able to work through this respectfully in order to diffuse the situation.</p>
<p>Personalites</p>
<p>Another element in building an effective technology support team is the consideration of the individual personalities of the team members. A team leader or management putting the team together needs to able to read people and decide what impact those team members may have on a team. Do the individual work well in a team environment? Do they handle peer critisism well? Are their work efforts and goals in line with the good of the team as a whole or are they self seeking? These are critical questions that a manager needs to consider if he or she is to build a team that will work well together for an extended period. If there is a significantly high rate of turnover on a team then training becomes an issue.</p>
<p>Conclusion</p>
<p>In my own experience in dealing with a technology support team as a consumer, it is important to me that the technology support person be sensitive to my particular problem. As recent as this passed week I had to call tech support for a network access issue with a company that I deal with regularly. I simply wanted to know why it was that I could send and receive emails from my personal email account using Microsoft Outlook without error at home, work and public access points; but I could not do so when connected to this one particular network. This was a network, which I spend a good deal of time on and it is a problem that I have to wait until I get home before I can send emails.</p>
<p>I suspected that it was a network security issue and that port 25, the outgoing mail server SMTP port; was closed to students. Instead of giving me an answer, the technology support staff member first tried to push the responsibility off onto my ISP. When I explained to her that I am the ISP and that I have a business which supplies web and email hosting services she seemed frustrated. After a brief discussion she indicated that I needed to contact Microsoft technology support and have them fix the issue. I explained to her that it is not a Microsoft issue because the software operates as expected on every network except theirs. Further I told her I had been setting up email clients since 1995 and this was not the problem.</p>
<p>Finally the technology support person placed me on hold for more that 20 minutes and I began to feel like I had been hung out to dry and so I eventually just hung up the phone because time was being wasted. This is a potentially volitile situation because had this been a consumer who was frustrated, they may have hung up the phone even more frustrated. These non-resolutions can severely impact brand popularity and sales over that duration of time.</p>
